By accessing and using the Médecins Sans Frontières (MSF) USA, Inc. d/b/a Doctors Without Borders (“Doctors Without Borders”, “we”, “us” or “our”) Science Portal website (referred to as the “Science Portal”) you agree to comply with and be bound by the following terms and conditions (“Terms of Use”) and the terms of our Science Portal privacy policy (“Privacy Policy”).

Please read these Terms of Use and the Privacy Policy carefully. If you do not agree to these Terms of Use and/or the Privacy Policy, please cease using the Science Portal.

Copyright, Trademarks, Ownership of Content

Unless otherwise expressly noted, content contained on the Science Portal, including scientific research papers, reports, data sets, graphics, text, photographs, trademarks, logos, videos, audio files and other information, including the layout, design, and the arrangement of such content, is owned or licensed by Doctors Without Borders. This content is protected by trademark, copyright, and other intellectual property and unfair competition laws.

You may download, print, and use content from the Science Portal for personal, research, non-commercial, informational, and/or scholarly use, but for no other purposes. Nothing on the Science Portal should be construed as granting, by implication or otherwise, any other license or right to use any of the content or the associated intellectual property rights. You may not modify, translate, distribute, market, display, sell, rent, or license any of the content on the Science Portal unless expressly permitted in writing by Doctors Without Borders. You agree to maintain all copyright and proprietary notices on the content that you use.

Content Provided on the Science Portal

The Science Portal is provided free of charge as a community service and Doctors Without Borders is not responsible for the accuracy of any content on the Science Portal or the non-availability of the Science Portal or any content on it. Doctors Without Borders also maintains the right to suspend, restrict, modify, or discontinue use to any or all parts of the Science Portal at any time.

Legal Complaints

We respect intellectual property rights, and these Terms of Use are intended to comply with the requirements of the Online Copyright Infringement Liability Limitation Act and the Digital Millennium Copyright Act. We will investigate notices of copyright infringement and take appropriate actions under the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c)(2) (“DMCA”). If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our copyright agent the written information specified below:

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
A description of the copyrighted work that you claim has been infringed upon.
A description of where the material that you claim is infringing is located on the Science Portal.
Your address, telephone number, and email address.
A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Use of the Science Portal

In using the Science Portal, you must not (i) provide us with inaccurate, incomplete, illegal, defamatory, or offensive information, (ii) engage in any conduct that restricts or inhibits any other person from using the Science Portal, (iii) violate or attempt to violate the security of the Science Portal, or (iv) engage in any use that is unlawful or could foreseeably result in harm to Doctors Without Borders, the Science Portal, or other persons.

Disclaimer of Warranties

All medical and scientific information on the Science Portal is meant as an informational resource only. Researchers and practitioners should rely on their own judgement, knowledge, and experience when evaluating and/or applying any research found on the Science Portal. The information on the Science Portal is not to be used as a substitute for the advice or diagnosis of a qualified medical professional.

By using the Science Portal, you expressly agree that access to and use of the Science Portal and its content is at your own risk. THE INFORMATION AND CONTENT PROVIDED ON THE SCIENCE PORTAL IS ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND DOCTORS WITHOUT BORDERS MAKES NO WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. DOCTORS WITHOUT BORDERS SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OR TITLE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Any link to an outside website or reference to another entity does not constitute an endorsement or warranty by Doctors Without Borders.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL DOCTORS WITHOUT BORDERS, OR ANY OF ITS AFFILIATES, BE LIABLE TO YOU, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHER THEORY, FOR ANY OF THE FOLLOWING: (I) LOSS OF PROFITS OR REVENUES; (II) LOSS OF BUSINESS; (III) DEPLETION OF GOODWILL OR SIMILAR LOSSES; (IV) LOSS OF ANTICIPATED SAVINGS; (V) LOSS OR CORRUPTION OF DATA; OR (VI) ANY DIRECT, SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL LOSS OR DAMAGE, EVEN IF DOCTORS WITHOUT BORDERS OR ITS AFFILIATES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. IN NO EVENT WILL THE AGGREGATE LIABILITY OF DOCTORS WITHOUT BORDERS (TOGETHER WITH ITS AFFILIATES) RELATED TO OR ARISING OUT OF THE SCIENCE PORTAL EXCEED $50.

Indemnification

You will defend, indemnify and hold harmless us, our affiliates, and their respective directors, officers, employees, shareholders, vendors, partners, contractors, agents, licensors or other representatives and all of their successors and assigns (collectively, the “Indemnified Parties”) with respect to all third party claims, costs (including attorney’s fees and costs), damages, liabilities, and expenses or obligations of any kind, arising out of or in connection with your use or misuse of the Science Portal or its content. We retain the right to assume the exclusive defense and control of any claim subject to indemnification, and in such cases you agree to cooperate with us to defend such claim. You may not settle any claim covered by these Terms of Use without our prior written approval.

Policy Changes

Doctors Without Borders reserves the right to amend these Terms of Use at any time at its discretion, without notice to you. Any changes will be posted on the Science Portal and continued use of the Science Portal will constitute acceptance of the most current Terms of Use available on the Science Portal.

Dispute Resolution

The Terms of Use, Privacy Policy and any disputes arising out of or related hereto, will be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of laws rules. The state and federal courts located in New York County, New York will have exclusive jurisdiction over any dispute relating to the Terms of Use and Privacy Policy, and each party consents to the exclusive jurisdiction of those courts.
